THE SYSTEM OF CONFIDENTIALITY

All information provided by the Client to Equanimity Executive, LLC during the course of the relationship will be deemed “Confidential Information” and kept strictly confidential unless otherwise agreed in writing. Equanimity Executive, LLC will not disclose any communications, either verbal or written, that have taken place either between Equanimity Executive, LLC and the Client or with regard to the content of this Agreement without the prior written consent of the Client.   This confidentiality restriction also applies to testimonials and use of the company name which Equanimity Executive, LLC may use for promotional reasons only with the consent of the Client.  The Client may request anonymity in connection with any testimonials to be used. Notwithstanding the foregoing, “Confidential Information” does not include information that is:   (a)   previously known to Equanimity Executive, LLC prior to discussions regarding this Agreement, free from any obligation to keep it confidential, or (b)   publicly disclosed by the Client either prior to or subsequent to the receipt by Equanimity Executive, LLC of such information, or (c)   independently developed by Equanimity Executive, LLC without any access to Confidential Information, or (d)   rightfully obtained by Equanimity Executive, LLC from a third party lawfully in possession of Confidential Information who is not bound by confidentiality obligations to the Client.   Equanimity Executive, LLC may disclose Confidential Information if required to do so under applicable law, rule or order; provided that Equanimity Executive, LLC , where reasonably practicable and to the extent legally permissible, provides the Client with prior written notice of the required disclosure. Equanimity Executive, LLC will return, or at the Client’s request, destroy, all copies of the Confidential Information in Equanimity Executive, LLC ’ possession or control within 12 months upon termination of this Agreement.

Payment Information

In case of services requiring payment, we request credit card or other payment account information, which will be used solely for processing payments. Your financial information will not be stored by us. We are using a secured third party financial provider Zohobooks and Authorize.net. Subject to your prior consent and where necessary for processing future payments, your financial information will be stored in encrypted form on secure servers of our reputed Payment Gateway Service Provider who is beholden to treating your Personal Information in accordance with this Privacy Policy Statement.
